What the authorisation covers

Smartbroker AG is authorised for 1 of the ten crypto-asset services defined in Article 3(1)(16) of MiCA. It is not authorised for custody and administration, operating a trading platform, exchange for funds, exchange for other crypto-assets, execution of orders, placing of crypto-assets, advice on crypto-assets, portfolio management, transfer services — if it offers those, that activity is outside this licence.

• a Custody and administration not authorised Holding clients' crypto-assets or the private keys to them, and keeping them safe. This is what a wallet service or an exchange that keeps your coins does.
• b Operating a trading platform not authorised Running a marketplace where buyers and sellers of crypto-assets are matched — an order-book exchange in the strict sense.
• c Exchange for funds not authorised Buying crypto-assets from clients, or selling to them, against money (euro or another currency) using the provider's own capital.
• d Exchange for other crypto-assets not authorised Swapping one crypto-asset for another with the client, using the provider's own capital — for example bitcoin for a stablecoin.
• e Execution of orders not authorised Concluding purchases or sales of crypto-assets on the client's behalf, including on a third-party trading platform.
• f Placing of crypto-assets not authorised Marketing newly issued crypto-assets to buyers on behalf of the issuer — the crypto equivalent of underwriting or an IPO placement.
• g Reception and transmission of orders 1 country Taking a client's order to buy or sell and passing it on to another provider that executes it — a broker that does not execute itself.
• h Advice on crypto-assets not authorised Giving personalised recommendations to a client about buying, selling or holding specific crypto-assets.
• i Portfolio management not authorised Managing a client's crypto-asset portfolio with discretion, under a mandate — deciding what to buy and sell on their behalf.
• j Transfer services not authorised Moving crypto-assets from one distributed-ledger address or account to another on the client's behalf.

Where it may operate

Smartbroker AG is authorised to operate only in Germany. It has not used the MiCA passport to notify other EEA states.
